Terms and Conditions: Digital Products and Video Lessons

1. Agreement to These Terms

These Terms and Conditions (“Terms”) are an agreement between you and Raising Kids With Purpose, LLC (“Raising Kids With Purpose,” “we,” “us,” or “our”). They apply to the Emotions Learning Play Pack, the Emotional Intelligence Parent Workbook, and any other digital products, printable files, and video lessons you purchase or access from us (the “Products”).

By purchasing, downloading, or using the Products, you agree to these Terms. If you do not agree, please do not purchase or use the Products.

These Terms work together with our [Privacy Policy] and [Disclaimer], which are part of this agreement. By purchasing, you also agree to those policies.

2. The Products

The Products are digital and may include downloadable PDF files, printable activities and games, video lessons, and written instructions. No physical items will be shipped.

You must be at least 18 years old to purchase the Products. The activities are designed to be used with children under the supervision of a parent, caregiver, or professional.

3. Your License

When you purchase a Product, we grant you a limited, non-exclusive, non-transferable license to use it as described below. You are purchasing a license to use the Products, not ownership of them.

Personal use

You may use the Products with your own children and family, and print as many copies as you need for that use.

Professional use (included with every purchase)

If you are a teacher, counselor, therapist, psychologist, social worker, behavior analyst, tutor, or other professional who works with children, your purchase also includes a single-user professional license. This license allows you, as one individual, to:

  • Use the Products with the children, students, or clients you personally work with, in person or virtually.
  • Print as many copies as you need for those children.
  • Share printed copies of activities with your students or clients for use during or as part of your work with them.
  • Share the Parent Guide, in print or digital form, with the parents and caregivers of the children you work with.

The professional license belongs to the person who made the purchase. It does not extend to colleagues, an entire school, district, clinic, or organization. Each additional professional who wants to use the Products needs their own purchase. For group or school licensing, contact us at adriane@raisingkidswithpurpose.com.

What you may not do

Unless we give you written permission, you may not:

  • Share, email, upload, or distribute the digital files or video lessons to anyone, except for the Parent Guide as described above.
  • Post the files or videos on a shared drive, website, learning platform, social media, or any other place others can access them.
  • Share your login or access with anyone else.
  • Resell, sublicense, give away, or claim the Products as your own.
  • Copy, modify, or adapt the Products to create a product you sell or distribute, including on marketplaces like Teachers Pay Teachers or Etsy.
  • Remove or change any copyright notices or branding.
  • Use the Products, or any part of them, to train or create content with artificial intelligence tools.

You may adapt how you run an activity to fit the child in front of you. That’s encouraged! You may not, however, create and distribute new versions of the materials.

Ownership

All Products, including the text, designs, activities, worksheets, and videos, are owned by Raising Kids With Purpose, LLC and are protected by copyright and other intellectual property laws. All rights not expressly granted in these Terms are reserved.

If you violate these Terms, your license ends immediately, and we may remove your access without a refund.

4. Access

After purchase, you will receive access to the Products by email and/or through our online course platform. You will have access for as long as we continue to offer the Products. We recommend downloading your files so you always have a copy.

We may update, improve, or change the Products over time. Updates are provided at no additional cost to existing customers when we make them available. Limited-time bonuses offered during a promotion are only available to customers who purchase during that promotion.

We use third-party platforms, such as ThriveCart and video hosting services, to deliver the Products. We are not responsible for temporary outages or issues caused by those platforms, but we will do our best to help you regain access.

5. Payments

All prices are in U.S. dollars. Payment is due at the time of purchase. You are responsible for any taxes that apply to your purchase.

6. Refunds

Because the Products are digital and can be downloaded immediately, all sales are final, and we do not offer refunds once the Products have been delivered.

If you have trouble accessing your files, are charged twice, or have another problem with your purchase, please email adriane@raisingkidswithpurpose.com and we will make it right.

Chargebacks and payment disputes

Please contact us before disputing a charge with your bank or card company so we can help. If you file a chargeback or payment dispute after receiving access to the Products, your license ends immediately, your access will be removed, and you must delete any downloaded files. We reserve the right to dispute the chargeback and to provide records of your purchase and access.

7. Educational Purposes Only

The Products are for educational purposes only. They are not therapy, counseling, medical care, or a diagnosis or treatment of any condition, and they are not a substitute for the advice of a licensed physician, mental health professional, or other qualified provider. Using the Products does not create a therapist-client, counselor-client, or any other professional relationship with Raising Kids With Purpose.

If you are concerned about a child’s emotional, behavioral, or mental health, or a child is in crisis, please contact a qualified professional or emergency services right away.

Professionals who use the Products remain fully responsible for using their own professional judgment, following their licensing and ethics requirements, and following the policies of their school or organization.

8. Safety and Supervision

Many activities involve movement, physical games, scissors, and small printed pieces. An adult should supervise children at all times and decide whether each activity is safe and appropriate for the child’s age, abilities, and environment. You use the activities at your own risk.

9. No Guarantee of Results; Testimonials

Every child is different, and results depend on many factors outside our control, including the child’s age, development, needs, and how often the activities are practiced. We do not promise or guarantee any particular result.

Testimonials, reviews, videos, and examples shared on our website, sales pages, and social media are real experiences of real children and families. They are shared as examples only and are not a guarantee that you or your child will achieve the same or similar results.

10. Affiliate Links

Some Products, including the Emotional Intelligence Parent Workbook, may contain affiliate links. If you purchase through one of these links, we may earn a commission at no extra cost to you. We only recommend resources we believe are helpful, but we are not responsible for third-party products, services, or websites. Please review them on your own before purchasing.

11. Disclaimer of Warranties

THE PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, TO THE FULLEST EXTENT PERMITTED BY LAW. WE DO NOT WARRANT THAT THE PRODUCTS WILL MEET YOUR REQUIREMENTS, BE ERROR-FREE, OR BE AVAILABLE WITHOUT INTERRUPTION.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RAISING KIDS WITH PURPOSE, LLC AND ITS OWNER, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY INJURY, LOSS, OR DAMAGE ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE PRODUCTS, WHETHER BASED ON CONTRACT, NEGLIGENCE, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE PRODUCTS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THEM.

13. Indemnification

You agree to indemnify and hold harmless Raising Kids With Purpose, LLC and its owner, employees, and contractors from any claims, losses, damages, and expenses, including reasonable attorneys’ fees, arising from (a) your use of the Products, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.

14. Changes to These Terms

We may update these Terms from time to time. The version posted at the time of your purchase applies to that purchase.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in Maricopa County, Arizona, and you agree to the jurisdiction of those courts.

16. General Terms

  • Entire agreement. These Terms, together with our Privacy Policy and Disclaimer, are the entire agreement between you and us about the Products.
  • Severability. If any part of these Terms is found unenforceable, it will be enforced to the fullest extent allowed, and the rest of these Terms will remain in effect.
  • No waiver. If we don’t enforce part of these Terms right away, we have not given up our right to enforce it later.
  • Events beyond our control. We are not responsible for delays or failures caused by events outside our reasonable control, including internet, platform, or technology outages.
  • Attorneys’ fees. If legal action is needed to enforce these Terms, the prevailing party may recover reasonable attorneys’ fees and costs.
